GDPR update

Eleanore Beard, Senior Associate, Brabners

Eleanore will discuss important GDPR principles, including key commercial changes currently being proposed:

  • The 8 Data Protection principles and the obligations that arise from them.
  • Data Controller and Data Processor; who and what are they, their roles and obligations (including how to identify the controller and processor)
  • Compliance - having the right internal frameworks in place and what this might look like.
  • The new Data Protection and Digital Information (No 2) Bill - key changes that are being proposed and what this means for you.

3:40pm
Regulatory/Employment Law update

Simon Whitehead, Partner, Brabners

Simon will unpack some potentially significant proposals that will impact your business:

  • Non compete; the global shift away from post termination non-compete restrictions.  The US has banned them. The UK is proposing to impose a maximum 3 month duration - how this would impact your business.
  • Worker Protection from Harassment.  The proposal to make employers responsible for third party harassment of their employees if they fail to take all reasonable steps to prevent it. What you can do to mitigate your risk from your suppliers, end clients to visitors attending your premises.
  • Retained EU employment law changes. What you can expect from the return of rolled up holiday pay to the TUPE consultation changes.
  • Workers Predictable Terms and Conditions Bill.  A bill supported by the Government to give workers and agency workers the right to request more predictable terms and conditions of work. How you can prepare.
  • HMRC’s focus on National Minimum Wage (NMW) compliance in the recruitment sector.  The NMW problems caused by common On Target Earnings renumeration structures for consultants.
