Compliance for International Trusted Partner Service Providers

Trusted Partners who offer or provide any Relevant Services outside of the UK, or who appear to APSCo to offer or provide any Relevant Services outside of the UK, are required under the Trusted Partner members' terms and conditions of membership to undertake a compliance questionnaire of a number of aspects of any Relevant Services provided ("International Compliance Questionnaire" or "Questionnaire"). 

“Relevant Services” means any of the following services offered or provided to, or in relation to candidates, including candidates operating as limited company contractors, would be considered Relevant Services for the purposes of APSCo’s International Compliance Questionnaire: 

  • Employee leasing
  • Professional employer services
  • Freelance support
  • Contractor support
  • Accounting services

Relevant Services includes, but is not limited to, the operation of umbrella companies and services supporting personal service company arrangements. APSCo will decide at its absolute discretion whether a service provided by a Trusted Partner company is a Relevant Service.

The APSCo International Compliance Questionnaire

The purpose of the Questionnaire is to give APSCo some reassurance that providers of Relevant Services outside of the UK who have completed the Questionnaire appear to have no obvious hallmarks of certain practices which might be in breach of tax or other laws.

APSCo may use the services of a Trusted Partner compliance specialist to review and interpret Questionnaire responses.

Neither APSCo or the Trusted Partner compliance specialist accept or assume any responsibility or liability whatsoever for any claims, demands, actions, proceedings, damages, losses, loss of profit, costs, expenses or any other consequences, whether direct or indirect, howsoever arising including but not limited to compliance for International Trusted Partner Service Providers and the International Compliance Questionnaire. Members, Trusted Partner members and third parties should be aware that the International Compliance Questionnaire cannot be relied upon to ensure that the Relevant Services are completely compliant.

The APSCo International Compliance Questionnaire process does not replace the need for Members and others to carry out their own due diligence, compliance checks and enter into robust contractual terms with any international contracting service providers they wish to engage.

Frequency of Compliance Reviews

An International Compliance Questionnaire will be completed initially on application for Trusted Partner membership, and thereafter at least annually.
